Marcia Sirota, President of The Ruthless Compassion Institute (the "Producer") is producing two podcast series; one about mental health and wellness, entitled Ruthless Compassion with Dr. Marcia Sirota (the “Podcast”), and one about mental health portrayals on film and television, entitled Reel Mental with Dr. Marcia Sirota (the “Podcast”). We are excited to have you (the "Guest") on our podcast.

In order to fulfill the necessary legal formalities, please read the following and, if acceptable, please check the box in the booking tool. You may only participate in the Podcast if you agree to and comply with the terms and conditions of this Podcast Guest Consent and Waiver, as well as any applicable local, provincial, and federal laws and regulations. For good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged:

1. I hereby grant to Producer, its legal representatives, successors, licensees, and assigns, the irrevocable right to record my voice, image, and performance as part of the Podcast and in any and all productions and uses based thereon (the "Productions").

2. The Producer is not obliged to use such recordings, but if it does, I also hereby grant to Producer the right to edit, modify, add to and/or delete material, juxtapose any part of it with any other element, change the sequence of events and to make any other changes in the Podcast and Productions that the Producer deems appropriate.

3. I acknowledge that Producer is and shall be the sole owner of all rights in and to the recordings and the Podcast and Productions as "works made in the course of employment" for the purposes of Canadian copyright law and I hereby irrevocably assign to Producer any and all right, title and interest in and to the recordings, the Podcast, the Productions and all the elements of both of them. I hereby waive my moral rights in the Podcast and Productions.

4. Included in the rights granted is the irrevocable right to advertise, promote and exploit the Podcast and Productions in all media, in all markets, and by all methods and means, now known or hereafter devised, but not as an endorsement of any product or service other than the Podcast and Productions.

5. I also irrevocably acknowledge and agree that I will not make nor assert any claim arising from the exercise of the rights granted for defamation, for invasion of privacy, for appropriation of personality, for breach of right of publicity, or for breach of or infringement upon any other personal or proprietary rights that I or my estate now have or may hereafter acquire and I hereby release you from any claims I now have or may have in that regard.

6. I hereby release and discharge the Producer from any and all liability arising out of or in connection with the making, producing, reproducing, processing, exhibiting, distributing, publishing, and transmitting by any means or otherwise using the Podcast and Productions.
